Salary for the Period of Illness

Question

Zayd was sent by Madrasa Ashraf al-‘Ulum, Burma, to East Pakistan for collecting donations. But because of the creation of Bangladesh he was detained there and remained detained for two years. What is to be ascertained is: will Zayd receive his fixed salary for these two years or not? (a) Ashraf al-‘Ulum used to give eighty rupees per month to Zayd’s home for subsistence. According to the Shari‘a, will these eighty rupees be a debt, or will they be counted as part of his salary? (b)

Answer

If the madrasa did not dismiss Zayd from employment and inform him of it, and Zayd also did not resign, nor did he take up employment or similar occupation anywhere else there, but, regarding himself as an employee of Madrasa Ashraf al-‘Ulum itself, remained engaged in effort as far as possible, then he will receive salary for those days. (a)
