Spending One Madrasa’s Money on Another Madrasa
Question
The co-father-in-law from the wedding procession — the donor — after enquiry and verification clearly stated: “I have given fifty rupees for the sake of Allah to the mosque and madrasa of Khera.” The situation, however, is that the mutawalli (trustee) of another madrasa took these rupees by cunning.
Answer
It is necessary (lazim) to spend that money precisely where it was given to be spent. If it has been spent elsewhere, liability (daman) will be binding, because the mutawalli is a trustee (amin) and an agent (wakil); he has no right to spend contrary to the donor’s explicit stipulation.
