Spending Money Collected for One Madrasa on Another Madrasa
Question
A group (jama‘at) established an Islamic madrasa, issued receipts and the like in its name, and collected donations, and for several months ran the madrasa on these donations. Later, when a considerable sum had accumulated, a few individuals decided to start an Islamic madrasa in another place. Is it now permissible or not to spend on the other madrasa the money that was collected for the existing madrasa — even though the first madrasa is in severe need of money and is badly in want of funds?
Answer
As long as the madrasa for which the donations were specifically collected is functioning and that money can be spent on it, it is not permissible in the Shari‘a to spend it on another madrasa, because the group that collected the donations is a trustee (amin)
