A Non-Muslim Making a Waqf for a Mosque

Question

(a) A non-Muslim wished to sell plots of his land for houses. The Muslims, according to their means, bought one plot and said, “There is no mosque in this new settlement; if one plot of land is given for a mosque, it will be convenient for us.” The landowner agreed to this and gave the requested plot free of charge, that is, he had it registered. Now the question is: is it permissible to build a mosque on land made waqf by a non-Muslim, or to build a mosque with the donations of non-Muslims, or not?

Answer

If, in the view of this non-Muslim, building a mosque is a good deed and for this reason he gave the donation or made the land waqf for the mosque, then it is correct: a mosque should be built there, and that money too should be put into the mosque. In Shami there is a discussion of the waqf of a non-Muslim, the gist of which is the same as what has been written here.
