The Ruling on Graves Adjoining the Mosque Courtyard

Question

A mosque has three sections: (1) the three-arched hall and so on, (2) the courtyard and so on, (3) graves. It is a mosque from the royal era. In section no. 1 all five daily prayers are held; in section no. 2 the ‘Isha’ prayer is held in the hot season; and the Eid prayer is held in section no. 3, which is an open space; people also sit there to smoke bidis (cheap Indian cigarettes) and the like, and the mutawalli (trustee) forbids this.

Answer

The place no. 3 is apparently not a mosque, since there are graves there; therefore the rulings of a mosque will not apply to that place, and going there without ghusl (the full ritual bath) will also be permissible. If the graves are in front during prayer, then praying there will be prohibited, even if it is the Eid prayer.
