Allocating Part of a Waqf for Allah as a Service Fee
Question
Question: A man obtained a large piece of land from a princely state for an annual land revenue. After that he built a mansion on it; the rest of the land around the mansion lay fallow. To enclose this mansion and land he built an unbaked (mud) boundary wall. From time to time huts for servants were also built on this land, and a large part of the land remained vacant. Land revenue was paid to the state for the mansion land and for the large plot. Then this man gave all this land and the mansion to a woman.
Answer
Nowadays tax is taken even from the owners of houses; if the land revenue on this land is of the same nature, then making this waqf is also valid. And if in a waqf some share — for example ¼ — is assigned as a service fee to the male and female descendants, this does not cause any defect in the waqf.
