Spending waqf income on what is not waqf
Question
Can the Anjuman Khadim al-Islam (the ‘Servant of Islam’ Society) of the Muslims of Goalpara be entitled to spend the money from the income of this box on the protection of the graveyard and the revered shrine and on other good works, or not? In short, on which purposes should these sums be spent?
Answer
Spend these sums on the very purpose for which they are given, provided that this purpose is not contrary to the Shari‘a. If they wish to spend them on some other good work besides the graveyard, they should obtain permission from the general public by means of an announcement, and then spend.
