Endowing land bought with the intention of a madrasa for a mosque or another good cause
Question
A generous and charitable Hanafi Sunni man bought an open plot, whose value on stamp paper is two and a half thousand rupees, with the intention of endowing it to a madrasa or a society. Now this man wishes to endow this plot or its value for a mosque. How is this act according to the Shari‘a? And does it carry reward and recompense or not?
Answer
(1) Even after buying it with the intention of a madrasa or society, that plot remains in the ownership of the buyer: by mere intention it did not become waqf for the madrasa or society. Now, if in his view endowing it for the mosque is more beneficial, he has the right to endow it for the mosque. (2)
