Materials of an endowed well used in new construction
Question
Near a mosque there is a well which an officer in charge of a police station took from the landowners and restored for the public good. For some time the well remained in operation; then, upon that police officer’s transfer, the second police officer gave no thought to keeping it in operation, and people pulled out most of the wooden fittings and burnt them, while some of the materials survived.
Answer
1. If that well is in operation and there is need for it, those materials should be spent on that same well. If it is abandoned, there is no longer any need for it, and another well exists, then those materials should be spent as needed on some other nearby well and not spent on the mosque.
