Transferring land endowed for “Faiz-e ‘Am” to a mosque
Question
Question: Zayd made several houses a waqf for the Faiz-e ‘Am High School; it has been 30 years since then. Among them was one dilapidated mud house, the whole plot of which was 8 gaz (a unit of length, about a yard, ≈ 0.9 m) long and 6 gaz wide. It is now a long time since the building collapsed, and the land lies vacant. Rebuilding it would cost two thousand rupees, and the high school has no money.
Answer
For what purpose of the mosque itself will this land, 8 gaz long and 6 gaz wide, be of use in this location? Nevertheless, if the waqf can be preserved in this way, and otherwise it will be lost, then in such a state of necessity this course is valid in the Shari‘a.
