A method for ending the conditional attachment of a major (mughallaza) divorce

Question

(1) Zayd imposed this condition on his wife: “تم پانچ بیگہ زمین کے بغیر میرے گھر میں داخل نہیں ہو سکتی، اگر اس شرط کو پوری کئے بغیر تم گھر میں داخل ہوئی تو تم کو تین طلاق” (“You cannot enter my house without five bighas (a local measure of land area) of land; if you enter the house without fulfilling this condition, you have three talaqs”).

Answer

(1–5) The house in which Zayd lives is, by custom (‘urf), Zayd’s house, even though his brother and sister are also shareholders in it. Therefore, if the wife enters it without fulfilling the condition, three talaqs will take effect. The easy way to be free of this is that he gives the wife one irrevocable (ba’in)
