The ruling on “if you wish — talaq, talaq”

Question

Zayd addressed his wife Hinda, saying: «اگر تم چاہتی ہو اور تمہاری خواہش ہو تو میری طرف سے طلاق طلاق» (“if you want and it is your wish, then from my side — talaq, talaq”); having said it twice he fell silent, and after that Zayd took her back (ruju‘). Two and a half to three months later, over some matter, Zayd again said the same: “If you want, I will fulfil your wish, but just let the children grow up a little; whatever you want, I will fulfil.” To this Hinda replied: «خدا مالک ہے» (“God is the Master”).

Answer

When Zayd said the first time, “if you want and it is your wish, then from my side — talaq, talaq,” and the wife did not want talaq and did not wish it, then no talaq took place. And since there was no talaq at all, there was no need for taking back (ruju‘) either. Then, when a conversation of this kind occurred again, the wife said «خدا مالک ہے» (“God is the Master”).
