Talaq by the Words “Let Her Break Her Bangles — I Now Have Nothing to Do with Her”

Question

Question: Nizamuddin has withheld maintenance (nafaqa) from his wife for a year, and, being very angry, he wrote a letter addressed to his father-in-law and wife, with hints and allusions and with added emphasis, in this manner: “You and your daughter think that she is more beautiful than Zulaykha. Marry her wherever you can; try to marry her within one year so that her life may pass in prosperity,” and words of that kind.

Answer

No explicit (sarih) word of talaq on the husband’s part has been quoted in the written (question); the words that have been quoted are allusive (kinaya). If he intended (niyya) talaq by these words, an irrevocable (ba’in) talaq has taken effect, and after the ‘idda the woman has the right to marry elsewhere.
