Talaq by the Words “She Is Dismissed from Me”
Question
Question: A man tells his wife to come home: “Let us go.” The wife says, “Very well,” and gets ready to go, but her father stops her, saying: “My daughter is not well; she cannot go for two or three days; when she gets well, then take her.” At this he says to another person: «میری بیوی سے کہہ دو کہ وہ مجھ پر برخواست یا نکاح سے برخواست» (“Tell my wife that she is dismissed as regards me (lit. ‘on me’) or dismissed from the nikah”); «لڑکی والوں سے کہہ دو کہ وہ اپنی لڑکی کا نکاح کہیں اور کر لیں»
Answer
If the husband said these words — «لڑکی والوں سے کہہ دو کہ وہ اپنی لڑکی کا نکاح کہیں اور کر لیں» (“Tell the girl’s family to have their girl’s nikah performed somewhere else”) — with the intention (niyya) of talaq, then talaq has taken effect: if he intended one, one has occurred; if he intended three, three have occurred.
