The Words «تیری رہی سہی کو طلاق» (“Talaq to Whatever Is Left of You”)

Question

Question: Among us a man had the following incident with his wife. The wife began saying: “I will go to my parents’ home.” The husband said: “I will not let you go.” The wife insisted on going. At this the husband became angry and blurted out: «اگر تو یہاں سے جا کر کہیں اور اچھی طرح سے رہی تو تجھے» (“If you go from here and live well somewhere else, then to you…”) — having said this he stopped, and then said: «تیری رہی سہی کو طلاق» (“talaq to whatever is left of you”).

Answer

If the custom (‘urf) there is that a wife is given talaq in this way — «تیری رہی سہی کو طلاق» — then two revocable (raj‘i) talaqs will take effect upon the condition being fulfilled. Then, before the passing of the ‘idda of three menstrual periods, the husband will have the right to take her back (ruju‘).
