The Husband’s Later Letters after an Irrevocable Talaq and His Claim of Taking Back

Question

To the honourable scholars, may Allah reward their efforts. Question: Several letters of Zayd addressed to his father-in-law were presented to you, respected sirs; on these, the respected Mawlana Mufti Kifayatullah and Mufti Mahmud Hasan had declared an irrevocable (ba’in) talaq already on the first letter, while the respected Mawlana I‘zaz ‘Ali and Mufti Sa‘id Ahmad had declared an irrevocable talaq on the second letter; the earlier fatwas are attached. (A)

Answer

(A) From (1) it is clear that some scholars declared Zayd’s words of talaq to be words of irrevocable (ba’in) talaq from the very outset, and some on the basis of the second letter; hence an irrevocable talaq has taken effect.
