Whose view the fatwa follows in the matter of i'tikaf
Question
If someone performing i'tikaf in the last ten days of Ramadan goes outside the bounds of the mosque for a while without a Shar'i or natural excuse, will his i'tikaf become invalid (fasid) or not? In this matter, in the present age, is the fatwa given according to the view of Imam Abu Hanifa ﵀?
Answer
Shaykh Ibn al-Humam ﵀ declared the view of the Imam A'zam ﵀ to be the preponderant (rajih) one, but from the manner of the author of al-Hidaya it appears that the view of the Sahibayn (the two companions of Abu Hanifa, Imam Abu Yusuf and Imam Muhammad) is preponderant. Therefore there should be no dispute in this matter: the view of the Imam ﵀ is the more cautious (awra')
