If the Fidya Cannot Be Covered in Full Owing to Insufficient Wealth

Question

If it cannot be paid from that portion, then what should be done?

Answer

Anything beyond that is not wajib upon the heirs. If the adult heirs each give their entire share of the inheritance towards the fidya, it will be a voluntary donation (tabarru‘); the share of a minor is not to be given.
