Food Given Beforehand Does Not Count Towards the Kaffara
Question
Zayd has been feeding a poor person for a year. Now the question is this: if Zayd, in Ramadan, while fasting, committed such acts as make both qada and kaffara wajib — for example, he deliberately ate or had intercourse — then, if Zayd makes the intention that in what he has fed the poor person there are two months of kaffara, will his intention be valid, or will he have to feed again?
Answer
What was fed beforehand will not now be counted towards the kaffara, just as paying the kaffara for an oath (kaffarat al-yamin) before breaking it (hinth) is not valid. The kaffara must be paid after the fast has been broken.
