The Imamate of a Fasiq and Fajir

Question

What, in the light of [the verse] [ar]وَإِنَّ ٱلْفُجَّارَ لَفِى جَحِيمٍ[/ar] “And indeed, the wicked will be in Hellfire” (Surah al-Infitar, 82:14), is [the ruling on] the imamate of one who is treacherous (kha’in), a fasiq and a fajir? And also, what are the clear signs of a fasiq and a fajir?

Answer

The imamate of a fasiq and fajir is makruh tahrimi, provided that another, righteous person more fit for the imamate than him is present. A fasiq is one who commits a major sin.
