Imamate of One Who Does Not Prevent Zina with His Sister-in-Law
Question
Another man commits zina with a certain man’s sister-in-law. Will the first man be a dayyuth (one who has no protective jealousy over his womenfolk) or not, and is it permissible to make him imam or not?
Answer
That man is not a dayyuth. However, if despite having the ability he does not prevent the zina, he is sinful; and if the sister-in-law is under his care and he still does not prevent [it], that is the utmost shamelessness, and the imamate of such a man is impermissible. As for the impermissibility of the fornicator’s own imamate, it is perfectly obvious.
