Nikah of a woman pregnant from zina with another man

Question

Is it permissible or not for an adulteress who is pregnant from zina to be married, while pregnant, to a man from whom she is not pregnant? And if it is permissible, is intercourse permissible or not?

Answer

The nikah is permissible, but intercourse before she gives birth is not permissible. [ar]وصح نكاح حبلى من زنا لا حبلى من غيره، وإن حرم وطؤها ودواعيه حتى تضع[/ar] “The nikah of a woman pregnant from zina is valid, but not of one pregnant from other than it, although intercourse with her and its preliminaries (dawa‘i)
