Which Comes First — the Khutba or the Offer and Acceptance? And the Qadi and the Agent Being Different Persons

Question

Here the offer and acceptance (ijab and qabul) are conducted first and then the khutba is read, and the reason given is that the offer and acceptance are wajib while the khutba is a sunna, so the offer and acceptance should come first and the khutba afterwards. The intention (?) of the offer and acceptance is conducted thus: “The daughter of so-and-so, through the agency (wakala)

Answer

(a) The khutba should be read first, and then the offer and acceptance conducted. The notion that the fard should come first and the sunna afterwards is not a general rule. In ablution (wudu), rinsing the mouth and putting water into the nose are sunna, while washing the face is fard; the sunna is performed first and the fard afterwards.
