Mentioning Food, Clothing, etc. in the Nikah

Question

Zayd recited the khutba after the nikah, and at the time of the nikah did not mention food, clothing and maintenance (nafaqa). Bakr claims that this nikah is not valid. Now the matter to be asked is: is the nikah valid or not?

Answer

Nikah is concluded by offer and acceptance (ijab and qabul), provided it takes place before at least two witnesses. The khutba before the offer and acceptance is sunna. This is what is mentioned in the books of fiqh — “ad-Durr al-Mukhtar”, “al-Bahr”, “Fath al-Qadir” and others. Food, clothing and maintenance are not mentioned in the nikah.
