Are those killed in riots martyrs?

Question

The Muslims who were killed in communal riots — did they become martyrs (shahid) or not? Or does it depend on their intention (niyya)?

Answer

Who killed them? Were they killed while attacking first, or while defending themselves? If they were killed as victims of injustice (mazlum), then they became martyrs.
