A father asked for bricks to build a brick-built platform on his grave: should they be given to him?

Question

Our father has gifted (hiba) all his property, together with both houses, in the names of us three sons, and along with this property we received about three thousand baked bricks. Now he is asking for five hundred of these bricks to build a raised platform over his grave. In this situation, should we give our father the bricks or not?

Answer

Give the bricks now; then, after his death, bury him in the graveyard in an earthen grave, and dismantle the platform made of the bricks given and divide [them] as inheritance (tarika).
