Giving a goat out for rearing for half the offspring
Question
Question: Zayd bought a goat and, without putting a price on it, gave it to Bakr to rear, saying that whatever young this goat gives birth to, they would divide half and half. Is it permissible to do this? Is the sacrifice of the young that came into Zayd’s share valid?
Answer
This transaction is not permissible, as is explicitly stated in al-Fatawa al-‘Alamgiriyya and by Shami. That young animal is the property of Zayd alone; for Zayd to take it and, once it becomes fit for sacrifice, to sacrifice it — all of this is valid.
