Giving an animal on a half-share basis
Question
Question: Is it permissible to give an animal on a half-share basis, i.e. the animal is mine and the care is yours; then, when the animal reaches the fixed term — a year or two — a third person sets the price of the animal, and of the two parties whoever wishes keeps the animal and whoever wishes takes the price. Is this arrangement permissible or not? And what is the permissible way?
Answer
This arrangement is an invalid lease (ijara fasida), which is impermissible. The permissible way is this: having put a price on the animal, a half share is to be sold; now the other person buys this half; then the owner of the animal forgives this half of the price.
