An employee’s salary for days of absence

Question

Question: An employee of a waqf left after taking two days’ leave and came back after six days. The question is: what is the ruling on the employee taking his salary for those four days, and should the mutawalli (trustee of the waqf) pay it or not?

Answer

If the terms of employment state that salary will be deducted for absence without obtaining leave, then in the case asked about the salary will be deducted. If the terms also allow a certain period of being off and not attending without obtaining leave, then the salary for that period will not be deducted, while for anything beyond it, it will be.
