If there is a fear that an heir will sell his share

Question

Question: During my lifetime I wish to divide my house into shares according to the Shariʿa and hand them over into the possession of my three sons and one daughter. My wife and I are pleased with the middle and the youngest son and with the daughter. With the eldest son is a wife, by whom he has two sons and three daughters.

Answer

Since you wish to give it during your lifetime, divide it into four equal shares and give three shares to the three sons and one share to the daughter; that is, the daughter’s share will be equal to a son’s, not half of it.
