An oral gift of property
Question
Question: My mother, Musharraf Jahan Begum, made an oral gift of all her property to me about ten years ago; as a further precaution she informed me of it by letter: “I received your letter. This time you were very late in sending a letter. It appears that people are raising objections regarding the property that I gave you on 5 February 1956 by making an oral gift of it to you.
Answer
If, having made a gift of her property, she gave you separate possession of it and removed her own possession, then that property has become yours. If other heirs were also shareholders in the inherited property, it is obligatory to give them their share: your mother has no right to make a gift of it.
