Stating in a Hajj Application That One Is from Another Province

Question

A person intends to perform Hajj to the House of Allah. Since in U.P. (Uttar Pradesh), owing to the large number of pilgrims, applications are mostly not approved, if someone, by way of a stratagem (hila), presents himself as a resident of another province — Bengal or Bihar — and gets his application approved, will this act be permissible in the Shari‘a or not? Does this act fall under lying or not?

Answer

If he has lived in the other province for some time, or lives there, then attributing himself to it is also not without basis: among the hadith scholars too, attributing oneself (nisba) to a place after residing there for a specific period is valid. Moreover, if this attribution does not infringe anyone’s right, there is latitude for it.
