Detailed Explanation of Hajj Badal (Pilgrimage on Behalf of Another)

Question

(1) Hajj was obligatory upon Zayd's father, but he did not perform it and did not make a bequest to his heirs to perform Hajj Badal on his behalf. A long time after his death, Zayd realised this and voluntarily (tabarray'an) commissioned 'Umar to perform Hajj on behalf of his father, permitting him to depart before Ramadan.

Answer

The jurists have mentioned several conditions for Hajj Badal. Among them: that the commissioned person (ma'mur) dons the ihram from the miqat of the one who commissioned him (amir), and that he does not perform tamattu' (if simply commissioned to perform Hajj). However, these conditions are obligatory only when the deceased left a bequest.
