Performing Hajj with One’s Brother without the Husband’s Permission

Question

Zayd’s wife insists, against her husband’s will, on going for Hajj this year; her full brother is also going for Hajj. Because of his domestic circumstances Zayd withholds permission this year — that is, Zayd’s wife does not fulfil her husband’s rights. Zayd’s sister has also submitted an application for her Hajj; if Allah wills it, Zayd’s house will be left empty, and apart from these two there is no other trustworthy person at his house.

Answer

If this woman owns so much money that Hajj has become fard upon her, and a mahram who will travel with her is also available, then she must certainly be given permission: the husband has no right in this situation to hold her back from Hajj.
