A father asks for bricks to build a solid platform over his grave: should they be given to him?
Question
Our father has gifted (hiba) all his property, together with both houses, to us three daughters …, and along with this property we received about three thousand fired bricks. Now he is asking for five hundred of these bricks to build a raised platform over his grave. In this situation, should we give our father the bricks or not?
Answer
Give the bricks now; then, after his death, bury him in the graveyard in a plain earthen grave, and dismantle the platform made of the bricks that were given and divide it as part of the estate (tarika).
