Selling an animal’s meat before slaughter
Question
People sell the hide, meat, thigh and so on of a live animal before slaughtering it, and a shopkeeper buys and sells the meat and so on; customers take it from the shopkeeper and use it. Is this sale correct or not?
Answer
Selling in this way is a defective (fasid) sale. It is wajib upon the seller and the buyer to rescind (faskh) such a sale; if they did not rescind it, both will be sinful. As for the person who bought this meat from him, defectiveness will not arise in his case from this purchase: the sale will be correct, even if he has no knowledge of the original sale.
