Selling the land of a minor nephew
Question
Question: There is a minor boy of a non-Muslim whose father has died; the boy’s full paternal uncles are alive. The uncle wants, acting as guardian (wali), to sell his own land and the land of the boy’s father. Is this sale to a Muslim permissible or not; may a Muslim buy it or not?
Answer
If in their religion the uncle has the right to sell his nephew’s land in his capacity as guardian, then it is valid for a Muslim to buy it; otherwise not.
