The ruling on ‘ushr on the produce of the land

Question

The farmers who set aside a fortieth part of every harvest — may they use that money to build a veranda over the mosque’s drain, given that the drain is separate from the mosque?

Answer

After the ending of the law on the landlord system, zakat on the produce of the land is no longer wajib. Whatever is given in the path of God as voluntary charity is a cause of good and blessing; spending it on any good work is correct according to the Shari‘a. Having the mosque’s veranda, drain and the like built with it is also correct.
