Return of zakat money after tamlik
Question
(1) In our town of Laupura there is an Islamic elementary school. Four hundred and thirty-six rupees of zakat came from another place to the rector in the name of the school. The school had no avenue for spending zakat, so the rector gave these 436 rupees of zakat to another person, Zayd, by way of tamlik (transfer of ownership), and said: “I have given this money to the madrasa; spend it on the needs of the madrasa.
Answer
When this money came to the respected rector in the name of the school, the rector had no right to give it to an outsider. Because he gave it to an outsider, daman (liability for compensation) is binding upon him; or else, spending on the school whatever amount that person gave is valid on behalf of that giver.
