The Hila of Tamlik
Question
Members of the biradari (a kinship or caste community) wish to spend zakat money on the poor, the madrasa and buildings within the mosque compound. They propose the following way: the zakat money is given to the rector of the madrasa, who is in debt and is not an owner of the nisab, and he then, on his own behalf, spends it on the mentioned purposes, immediately or when there is a need.
Answer
Zakat will be discharged in this way: [ar]من عليه الزكاة لو أراد صرفها إلى بناء المسجد والقنطرة لا يجوز، فإن أراد الحيلة فالحيلة أن يتصدق به المتولي على الفقراء ثم الفقراء يدفعونه إلى المتولي ثم المتولي يصرف إلى ذلك، كذا في الذخيرة. اهـ[/ar] “If the one on whom zakat is due wishes to spend it on building a mosque or a bridge, it is not permissible.
