Playing Kabaddi and the Like in a Graveyard

Question

In a public graveyard whose unpaved (earthen) graves have become level with the ground, is it permissible or not to play kabaddi (an Indian team game), ball, cricket and the like?

Answer

On land that is a waqf for burying the dead, all these activities are forbidden, whether the graves are visible or have become level with the ground, [ar]لأن شرط الواقف كنص الشارع[/ar] “because the stipulation of the waqif is like the text of the Lawgiver.”
