A Skull Turned Up While Digging a Well

Question

We were digging a well when a skull of a dead person came out of it. Some people say this was a graveyard; others say it was never a graveyard; ten years ago this land used to be cultivated.

Answer

If this place is not waqf but owned, then digging a well here, cultivating and planting an orchard are all proper. After the passage of such a long period, when the deceased has turned to dust in the grave, the ruling of a grave no longer remains.
