A Working Committee Borrowing from the Mosque Fund to Spend on the Madrasa

Question

In the working committee of the above-mentioned institution there is a Jami‘ mosque which manages the madrasa and adjoins the madrasa. This mosque’s income comes partly from a waqf and partly from the rent of the mosque’s shops. Is this committee authorised, if there is no money in the madrasa’s fund, to borrow from the mosque and spend it on the salaries of the madrasa’s teachers and the like? Also, will the sum taken from the mosque under the name of a loan be due for repayment or not?

Answer

Borrowing from the mosque’s money and spending it on the madrasa is not allowed: the mosque’s money is a trust (amana), and there is no right to dispose of it. Any sum taken in this way should be returned as soon as possible.
