Does a place take the ruling of a mosque once its foundation is laid?
Question
Will it be called a mosque after the whole building of the mosque has been constructed, or is merely the laying of the foundation sufficient? If the foundation is sufficient, then in such a mosque, where only the foundation has been laid, should all of the following be prohibited: performing ablution, taking a ghusl, cultivating crops, grazing animals, the builders smoking bidis (thin Indian cigarettes rolled in a leaf) and cigarettes, strolling about, and going there bare-bodied?
Answer
If the one to whom that land belongs, before building the mosque, gave people permission to hold the adhan, prayer and congregational prayer there, intending that the adhan, prayer and congregational prayer would always be held there, and declared it a mosque, then it has become a mosque in the Shar‘i sense.
