The ruling of a mosque from the laying of its foundation
Question
(1) Do the rulings of a mosque come into effect with the laying of its foundation, or will they come into effect when the adhan and the congregational prayer are held there? (2) In the mosque referred to, the prayer area and the qibla-side wall have already been raised to a man’s height, the walls on both sides, i.e. the north and south walls, have been put up, and the courtyard of the mosque has also been filled in. This mosque is on the premises of the Madrasa Fayd al-Qur’an, which belong to the madrasa.
Answer
(1–2) That place was already a waqf for the madrasa, and the person who is the mutawalli (trustee) or the rector of the madrasa has general authority from the waqifs to build on this land whatever structure he deems in keeping with the interests of the madrasa.
