Sale of a house endowed for a mosque
Question
Question: A mutawalli (trustee of a waqf) sold a house that is a waqf of a mosque after obtaining permission for it from the Sunni Central Waqf Board. What is the ruling on this?
Answer
For selling a house that has been endowed for a mosque, the permission of the Sunni Central Waqf Board is not sufficient: there is no right to sell an endowed house. The mutawalli should be called to account as to why he sold it, since it is not something that can be sold; the sale should be annulled and the house declared a waqf as before.
