Transferring ownership of waqf land after the waqf is made
Question
Question: Ten years ago the respected Abu Qalandar bought five gunthas (a local measure of land area) of land in Katraj, in the suburbs of the city of Pune, for the purpose of building a house; the laying of the foundation had also begun. After about two years had passed, Hafiz Idris and some respected ‘ulama went to him on the matter that there is no madrasa in Pune and all of us are searching for a place for a madrasa.
Answer
If land has been made waqf, ending one’s ownership of it and giving it into the ownership of Allah, and one’s possession as owner has been removed and it has been given over to Allah, then its sale is not valid, and that land is no longer capable of becoming owned property.
