Usurping possession of waqf land

Question

Question: The father and elder brother of one of the teachers, who have by now passed away, had made some land waqf in the name of the madrasa. For twenty years the income of this land kept coming to the madrasa. Now this teacher, whose father had given the land to the madrasa, has, on account of (his) being removed from the madrasa, usurped the income of this land and the land as well. Is this action of his permissible in the Shari‘a or not?

Answer

Without doubt this is usurpation (ghasb), and this is a grave sin. Every effort should be made to have this land recovered.
