Can waqf land become owned property again?
Question
Question: Hajji ‘Abd al-Wahid was one of four brothers; the two elder brothers, Rahmatullah and ‘Abd al-Hafiz, have passed away, and the father passed away on 18 January 1927. Near the neighbourhood, adjoining the general graveyard, there was an old plot of land; in it first the mother and then the father were buried.
Answer
When owned land was bought from its owner and, the sale having become complete, a mosque was built on it and part of the land was made a private graveyard (not waqf), then without doubt that mosque became a mosque in the Shari‘i sense, and the Friday and other prayers that were held in it are all valid.
