Claiming maintenance by means of a false document while living at the parents’ home
Question
Question: A dispute arose between the respected Ansar and his wife Zahida over the non-payment of Zahida’s maintenance and the non-fulfilment of other promises. Thereupon Ansar proposed (lit. “chose”) to his father-in-law and his wife that the parties file their claim regarding their disputes through the Muslim community council or the Qureshi Court of the Noble Shari‘a in Bhopal, and adopt a just settlement and the religious procedure.
Answer
(1/2/3) Even if Ansar willingly and gladly permitted Zahida to live at her parents’ home and promised to give fifty rupees a month, he in no way gave permission to live independently against religion, nor does he have the right to give it; and even if he were to give such permission, it is not valid in the Shari‘a, and the one who gives such permission is sinful.
